Circular - Proforma for reporting liquidator’s decision(s) different from the advice of Stakeholders’ Consultation Committee (SCC) under proviso to sub-regulation (10) of regulation 31A of IBBI (Liquidation Process) Regulations, 2016
This IBBI circular provides a specific reporting mechanism for instances where a liquidator deviates from the advice of the Stakeholders' Consultation Committee (SCC). While SCC advice is non-binding, any diverging decision must now be recorded in writing and reported via a new electronic proforma on the IBBI website within five days.
