SOCIAL SECURITY, BENEFITS, AND WELFARE COMPLIANCE CHECKLIST

Social Security, Benefits, and Welfare Compliance Checklist provides a concise framework for ensuring compliance with key Indian employment and social security requirements, including EPF, ESI, gratuity, maternity benefits, gig and platform worker provisions, and state-specific Labour Welfare Fund obligations. It highlights applicability, contribution rates, eligibility, statutory timelines, employee benefits, and potential financial implications to help organizations identify compliance requirements and manage statutory obligations effectively.

  • Mandatory Facility: On-site or designated crèche facility is compulsory for establishments with 50 or more employees.
  • Timeline: Immediate operational integration into company leave and facility management policies.

  • Contribution Mandate: Aggregators must contribute 1% to 2% of their annual turnover toward the designated Social Security Fund.
  • Portal Mapping: Mandatory registration of gig and platform workers on designated government portals using Aadhaar.

6. Labour Welfare Fund (LWF) State-Specific Governance

  • Applicability: Operates via independent State Labour Welfare Boards across roughly 16 states/UTs (varying rules, no central uniformity).
  • Contribution Structure: Fixed rupee amounts split between employee and employer (differing widely by state).
  • Filing Schedules: Disparate timelines by region—examples include Maharashtra & Gujarat (half-yearly in June/December), Karnataka & Tamil Nadu (annual cycles), and Haryana & Punjab (monthly by the 15th).
